Summary
In Poland there are about 250 000 Jehovah’s Witnesses. Among doctors, especially specialists in the areas of surgical treatment, contact the Jehovah’s Witnesses often causes problems associated with transfusion of blood and blood components before and after surgical procedure.
In the twenty-first century medicine is mainly focused on the patient rather than the disease. Paternalistic approach in the doctor-patient relationship was considered inadequate. Currently, the patient has the right to autonomously decide about everything that concerns him. Patients’ rights are protected in international and domestic law. Transfusion of blood and its components against the will of Jehovah’s Witness makes the doctor, who is the person responsible for blood transfusion, the responsibility enshrined in the code of civil or criminal penalties.
This article presents the case of a patient – Jehovah’s Witness – operated for rectal carcinoma. The article focuses on the discussion of the legal aspects related to the autonomy of the patient to self-determination no-transfusion blood and its components.
